Terms and Conditions
Definitions
"V|Hotspot" refers to interVations or it's subsidiaries.
"Client" refers to the end user or their associated business.
"Service" refers to the Internet access service provided by V|Hotspot to the Client.
"Account" refers to the Internet service account created for the Client by the interVations V|Hotspot equipment.
Use of the Services
V|Hotspot reserves the right to suspend or terminate, with or without notice, any Client's access which, in V|Hotspot's opinion, is directly or indirectly involved in activities which are detrimental to V|Hotspot's Internet service or jeopardise the use of V|Hotspot's service or its performance for other Clients or how the wider community will perceive V|Hotspot. This includes, but is not limited to 'spamming' e-mail or forwarding 'spammed' e-mail to other Internet users' e-mail addresses, Clients listed or who cause the listing of V|Hotspot or its Clients on any Real-time Black List, e-mail bombing and the use of bulk e-mail programs to unsolicited recipients, commercial advertising, informational announcements, charity requests, petitions for signatures, chain letters and political or religious messages, attempted unauthorised access to other Internet servers and systems, misrepresentation and abusive or offensive behaviour in newsgroups and other online facilities.
V|Hotspot assumes no responsibility or liability arising either from the content or for any error, defamation, libel, slander, omission, falsehood, obscenity, pornography, profanity, danger or inaccuracy contained in any information accessed. The Client is prohibited from posting or transmitting any unlawful, threatening, libelous, offensive, obscene, scandalous, inflammatory, pornographic, or other materials that could constitute or encourage conduct that would be considered a criminal offence, give rise to civil liability, or otherwise violate any law.
Limitation of Liability
In some cases it may not be possible to provide the wireless hotspot service and in such an event both parties will be released from their obligations under these Terms and Conditions and V|Hotspot will have no liability to the Client. The Client accepts that some services offered by the Third Party Carrier's Network infrastructure are incompatible with the wireless hotspot service and may not be available to the Client, after connection to the wireless hotspot network.
The wireless hotspot service is used at the Client's own risk and V|Hotspot and its associated venues take no responsibility for any data downloaded and/or the content stored on the Client's computer. The Client agrees not to make any claim against V|Hotspot, its suppliers, employees, contractors or assignees for any loss, damages or expenses relating to, or arising from, the use of the wireless hotspot service.
V|Hotspot will use its best endeavours to make the wireless hotspot service available to the Client during the venues operating hours. The Client acknowledges that V|Hotspot cannot guarantee uninterrupted service, the speed, performance or quality of the wireless hotspot service. The Client further acknowledges that the wireless hotspot service is not fault free and there may be interruptions and/or access problems from time to time as V|Hotspot depends on the performance of Third Parties over which V|Hotspot has no control and therefore can accept no liability for problems that may arise from the service.
Payment terms
The client is responsible, for all charges in respect of the use of the wireless hotspot services whether or not such usage was authorised. It is the Customer's responsibility to maintain the security of the means of access to the wireless hotspot services and to ensure unauthorised use does not occur.
The Client agrees that all monies are non-refundable, and that the service access fees are payable in advance.
General
Neither party shall be responsible for delays or failures in performance resulting from acts beyond its control, such as acts of God, acts of war, epidemics, civil insurrection, riot, power outages, fire, earthquakes and other disasters.
The Terms and Conditions of this Agreement supersede any previous agreement or statement of terms and conditions between V|Hotspot and the Client.
By the use of the service, the Client accepts the Terms and Conditions set forth in this Agreement.
The Client acknowledges that V|Hotspot may make and store records of personal information as per V|Hotspot's privacy policy.
V|Hotspot reserves the right to change these Terms and Conditions without notice to the Client. It is the responsibility of the Client to review V|Hotspot's Web site periodically to ascertain whether these Terms and Conditions have changed. The amended Terms and Conditions will become effective as soon as they are posted on V|Hotspot's Web site, following which, if the Client continues to use the service, the Client is deemed to have agreed to be bound by those amendments.
Privacy Policy
This document sets out the practices of the interVations in relation to the handling of personal information collected from visitors to interVations websites.
Statement of Commitment
interVations respects the privacy rights of all individuals visiting interVations websites and is committed to collecting and storing personal information in an ethical and appropriate manner. Furthermore, interVations is committed to ensuring that all interVations directors, officers, employees and agents comply at all times with the interVations policies and obligations under privacy legislation currently in force in Australia, New Zealand, the United Kingdom, Ireland and Hong Kong. interVations has adopted the National Privacy Principles (the Principles') contained in the Privacy Act 1988 (Cth) of the Commonwealth Government of Australia for the purposes of developing these policies. A copy of the National Privacy Principles is available from the interVations Privacy Officer or via the internet at www.privacy.gov.au.
Why do we collect personal information?
When you visit an interVations site, interVations service provider may record your server address, domain name, the date and time of your visit to this site and the pages you viewed. This information is used for statistical and website development purposes only.
We collect personally identifiable information that is specific and volunteered by visitors to interVations websites. This information may include your name, title, company, address, contact telephone number and email address. We may also request other personal information about you as part of an Online Application for current employment opportunities, surveys, special offers or when you request particular services.
This information is typically used for accessing specific site areas and reference material, information requests, submitting resumes and ensuring that communications are relevant.
interVations is committed to complying with the Australian SPAM Act 2003, which relates to how companies deal with 'electronic messaging'. This act outlines strict guidelines covering:
- Consent . Electronic messages of a commercial nature can only been sent to individuals who have given direct or inferred' consent.
- Identify . All Electronic messages of a commercial nature must clearly identify the Company responsible for sending the message
- Unsubscribe . All Electronic messages of a commercial nature must contain a functioning Unsubscribe' facility that is in operation for a minimum of 30 days from the date the message was successfully delivered.

Where we have obtained your consent, we may send you promotional information from time to time, including details of current issues, future events, or seminars. If you no longer wish to receive this information you may remove your name from our list by either;
- following the 'Unsubscribe' instructions contained within the email
or
- e-mailing us at info@intervations.com.au with your full name and email address details.
Once you have requested to Unsubscribe from receiving Electronic messages from interVations you will receive electronic confirmation you have been removed from the list within 5 working days.
Information will not be disclosed to third parties without your consent, except where it is provided to a contractor or supplier for the purposes of undertaking services which are required for the ordinary administration of the interVations business.
Cookies
Cookies are pieces of information that a website transfers to your computer's hard disk for record-keeping purposes. Cookies also provide us with aggregate information on how people use our website, including identifying the pages visited. This information helps us to make ongoing improvements to our site. Cookies do not personally identify users, although they do identify a user's browser. Most Web browsers are set to accept cookies. Storage and security of your personal information
interVations will use reasonable endeavours to keep secure any information which we hold about you, and to keep this information accurate and up to date. Your information is stored on secure servers that are protected in controlled facilities. Information will be kept until it is out of date or no longer required, at which time it will be destroyed or de-identified.
You can also play an important role in keeping your personal information secure, by maintaining the confidentiality of any password and accounts used on the interVations website. Please notify us immediately if there is any unauthorised use of your account by any other Internet user or any other breach of security.
You can access, change or delete the information we keep about you
All personal information kept about you is available at any time via direct email request. To access your information, send an email to info@intervations.com.au with details of your request.
Where you have registered a profile with us when you have purchased products and solutions, you may access and review this information anytime by signing-in using the 'Clients Tools' feature of this website.
